Terms of Service

Sealda is a non-custodial crypto wallet app for iPhone. It creates wallets from a BIP-39 recovery phrase, restores them from a recovery phrase or an encrypted iCloud backup, or imports a private key. It keeps the keys on your iPhone and signs transactions on Tron, Ethereum and BNB Smart Chain only when you confirm them. Our servers read the blockchains for the app, prepare Tron transactions for your iPhone to check, pass the transactions you have signed to the network, and send notifications if you allow them.

Sealda is not a bank, exchange or custodian. We never hold your funds or your keys, and we cannot move, freeze or reverse a transaction. Sealda offers no buying, selling or exchange of crypto-assets, no fiat on- or off-ramps, and no interest, lending or staking. Nothing in Sealda is financial, investment, tax or legal advice, and the prices it shows are indicative.

You may use Sealda only if you are at least 18 years old and able to enter into a binding contract where you live, and only where using it is lawful for you. You may not use it if section 7 applies to you. Once it is released on the App Store, we will offer the iPhone app in all App Store countries and regions except China mainland and the United Kingdom.

By using Sealda you confirm that you understand:

• A wallet can be restored only from its recovery phrase, from its private key if you imported one, or from your encrypted iCloud backup with its password.
• A wallet imported from a private key has no recovery phrase; the key is its only backup.
• We cannot recover or reset your PIN, your backup password or a hidden-wallet passphrase. Without its passphrase, a hidden wallet's funds cannot be reached.
• Blockchain transactions are final. There is no chargeback or dispute process, and we cannot reverse a transaction sent to a wrong or malicious address.
• You must check the full recipient address and the network before you confirm. Address warnings, filtering of tiny and zero-value transfers, and notifications are best-effort aids: they can miss things or be wrong.

Sealda is completely free: there are no purchases, no subscriptions, no ads and no Sealda fees. The only cost of using it is the blockchain's network fee for each transaction you send, which goes to the network, not to us. The fee Sealda shows before you confirm is an estimate; the fee actually charged can differ.

The app relies on our servers for balances, history, fees, sending and notifications. We work to keep them available but cannot guarantee that they always will be, and we may change, suspend or stop them, giving notice where we reasonably can. If our services are unavailable your funds are unaffected: they are on the blockchain, and your recovery phrase or private key works in other wallets that follow the same standards.

We may limit or suspend access to our services for anyone who breaks these Terms, puts the service or other users at risk, or where the law requires it. You can stop using Sealda at any time by deleting the app; the Privacy Policy explains what data you can ask us to delete.

You agree not to:

• use Sealda in breach of the law, including sanctions, anti-money-laundering and counter-terrorist-financing laws;
• attack, overload, probe or scrape our servers, or try to get around their rate limits or security checks;
• distribute modified copies of Sealda, or use the Sealda name or logo to mislead people.

You confirm that you are not located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions administered by the United Nations, the European Union, the United Kingdom, the United States or the Czech Republic, and that you are not a person listed on, or owned or controlled by a person listed on, any of their sanctions lists. We may refuse or end access to our services — including notifications, history and sending — where sanctions law requires it.

Sealda depends on services we don't control: the blockchains themselves, node and data providers, Apple (the App Store, notifications, App Attest and iCloud) and our network and security providers. Their outages, errors or changes can affect Sealda, and their own terms apply to your use of them. Tokens such as USDT and USDC are issued by third parties, who can freeze them, change them or stop supporting them.

Sealda is proprietary software. The app, its code, the Sealda name and the logo belong to It services company s.r.o. or its licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose, under these Terms and, for the app obtained from the App Store, Apple's Usage Rules (section 14). You may not copy, modify, decompile or redistribute it except where the law expressly allows it.

Sealda includes third-party open-source components, which remain under their own licences: secp256k1.swift and libsecp256k1 (MIT), Argon2Swift (MIT) and the Argon2 reference implementation (CC0 1.0 or Apache 2.0), GRDB.swift (MIT) and SwiftProtobuf (Apache 2.0).

Nothing in these Terms limits your rights under those licences. We will send you their full texts on request.

Except where the law does not allow it, Sealda is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Crypto-assets are volatile, and blockchains and smart contracts carry their own risks: bugs, outages, wrong fee estimates or mistaken approvals can lead to permanent loss. If you are a consumer, you keep the statutory rights your local law gives you.

To the extent the law allows, It services company s.r.o. and its officers, employees and contractors are not liable for indirect or consequential loss, or for loss of funds, profits, data or goodwill, arising from your use of, or inability to use, Sealda — including loss caused by a lost recovery phrase or key, a mistaken transaction, or the failure of a blockchain or a third-party service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct, or your statutory rights as a consumer.

We may change these Terms, for example when Sealda or the law changes. We will tell you about material changes in the app or on this page at least 30 days before they take effect, unless a change is needed sooner for legal or security reasons. If you don't agree, stop using Sealda before the change takes effect.

These Terms are governed by the laws of the Czech Republic, and the courts of Prague, Czech Republic have jurisdiction. If you are a consumer, you also keep the protection of the mandatory law of the country where you habitually live, and you may bring proceedings in its courts.

Before going to court, please write to support@sealda.app; we will try to resolve the issue within 30 days. If you are a consumer, you have the right to have a consumer dispute with us arising from these Terms resolved out of court. The body responsible is the Czech Trade Inspection Authority (Česká obchodní inspekce), www.coi.cz.

These terms apply to the Sealda app obtained from Apple's App Store, in addition to the rest of these Terms:

• These Terms are concluded between you and It services company s.r.o. only, and not with Apple Inc. ("Apple"). It services company s.r.o., not Apple, is solely responsible for the app and its content.
• Your licence to use the app is a non-transferable licence to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
• It services company s.r.o. is solely responsible for maintenance and support of the app, as described on our Support page or as required by law. Apple has no obligation whatsoever to provide maintenance or support for the app.
• It services company s.r.o. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of It services company s.r.o.
• It services company s.r.o., not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including (i) product liability claims, (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy or similar legislation.
• If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, It services company s.r.o., not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

• You must comply with applicable third-party terms when using the app, for example your wireless data service agreement.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and when you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
